Legal Question in Credit and Debt Law in Florida
collection
I have a Law Firm collecting on a worthless check, supposedly, written by me in 2000. They won't allow me to dispute it claiming that my 31 days to dispute was over after I spoke with them in September of 2006, which I never did. They are rude and plan to take legal action against me... what can I do? Do they have legal grounds?

Re: collection
It doesn't matter if they are rude.
You have 30 days to make good a worthless check. Either the law firm or the payee should have sent you a letter, either by regular mail or by certified mail, notifying you of the bad check. They do not need to prove you received the letter, only that they sent the letter. If you didn't make good the check, then they can sue in for the face amount of the check, plus more.
