Legal Question in Credit and Debt Law in Florida
Collection for spouse
We just started to get collection notices from a credit card that my wife had about 4 years ago and she stopped paying on it because she simply just didn't have the money. now the balance is in the 14000 range and they want to start collecting and I want to know if they can come after me or can they ruin my credit if we do not own anything together ? or will they just go after her ? we do have joiint bank accounts and file our taxes together ? Thanks for any info you can provide

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
If you did not sign for the credit card, they probably cannot go after you. You are not responsible for a debt which your spouse incurred without your signature.
If you have joint assets and joint accounts, your monies might get frozen or garnished. It would up to you to challange any wrongful collection activities and it could become costly. You would probably be smart to separate your assets now and place them in individual accounts. This should avoid the wrongful taking of your assets.
