Legal Question in Credit and Debt Law in Florida
About to go to collections for a bill already paid
Hello All - Having an issue with an old landlord threatening me wih collectins over a bill already paid.
Moved out on mid-'08. At exit interview supplied all new contact information (address, phone number). I have a copy of he exit interview with proof they had my new information.
2 weeks later got final bill from landlord (to new address). Charges were not correct, sent back a letter dispiting the charge along with a check for the difference. The check was cashed. I have a signed return receipt of the letter sent as well as phone records showing I tried to call and follow up. Never recieved a reply.
1/'09 - Recieve a call from collections agent threatening to report me to credit bureau if I dont pay. I dispute the charge and show all evidence I have of payment. They said that tried to contact me, but they were conatacting the OLD address. They KNOW I do not live there. No evidence they tried to contact me, I have evidence to support my good faith effort to pay any debt.
I have a feeling they are going to report me anyway. This day and age credit is gold and who know how much it could cost me.
Whay are my options? How can they report me for a paid bill? Can I sue for damages?
Thank you

If it were me, I would send a letter both to the collection agency and the landlord threatening them with a lawsuit for credit slander if a report erroneous information to your credit. You might also consider signing up for a credit monitoring service to make sure they don't report you.
