Legal Question in Credit and Debt Law in Florida
collector after debt which occured before disabilitating medical problem & was u
1988 suffered ruptured brain aneurism disabilitating me for long period time. Was in rehab unable to work for over a year. At time this occured held 2 credit cards with $1000 limit unable to make further payments on. Was harrassed extensively, but eventually told by contact with Citibank Visa contact would be ceased and debt would be discarded.
After rehabilitating for long period of time, in 1995 when I was first capable of handling renting an apartment on my own I had my credit run by complex and other card outstanding when had aneurism (amex) was on report - VISA NOT ON CREDIT REPORT (would have settled then - so assumed debt discarded due to circumstances.
After 13 years now recd ''settlement offer'' from NCO Financial Services to be allowed to settle my debt for the lump sum of $1298.24 (half of the total with interest occuring for 13 years).
I feel the request for this money now after 13 years of interest piling up with no hiding by me & no contact being made and no sign of debt on credit report for 8 yrs cannot be appropriate/legal.
Advice on handling settlement company contact?

If you took out the debt in Florida the statute of limitations is five years from the date of default which is normally the last payment made. After 13 years I don't think I would pay them. Talk direct to an attorney. A.J. Comparetto, Esq., 727-328-7900 www.helpwithlaw.com

I urge you to se a competent atty to protect your rights. In most jurisdictions the statute of limitations would bar enforcement of the debt. Don't pay anything.
