Legal Question in Credit and Debt Law in Florida

A collector came to my house with a cop. Is this legal?

A few months ago an elderly lady knocked on my door and said she had a letter from my mortgage company and that I needed to pay them. I took the letter from her and politely told her not to come back again.

In November she showed up with a cop. The officer said that she asked him to escort her to deliver a fax to me, because she was afraid of me and I had threatened her. I didn't threaten her.

I explained to the officer what was going on and he became kind of irate. He allowed me to file a report against her and told her to stay off my property. She kept saying she was from my mortgage company.

My mortgage company says that she doesn't work for them. She says that she isn't a debt collector and has been doing this for years.

She has also contacted my nighbors and questioned them. I am not behind on my mortgage and am not delinquent on any debts.

I think she is a debt collector. I think she made the officer think she was serving me with some sort of court paper.

The department of financial regulation says she is not licensed to collect debts in the state of Florida.

I am still angry about her bringing a policeman to my home, to try to collect a bogus debt.

Is what she did illegal?

Re: A collector came to my house with a cop. Is this legal?

It appears that it is a violation of the FDCPA and may even violate criminal laws. I would be interested in talking to you over the telephone and ask that you try to see who she works for? She must have told the cop something. Also, what does it say in the police report? if interested, please call my office at 305.860.1221. Our firm does not take any fees up front.
