Legal Question in Credit and Debt Law in Florida

Collectors off my back

I have 3 debt collectors on my back everytime I try to talk to them to work out payment they want it in full and constantly call my house. I can not pay any of them in full. How can I make a legal letter with a payment plan that will allow me to pay off my debt without them calling my house so much?

Re: Collectors off my back

Understand something: none of the collectors could give a rat's behind whether you pay the other two. Why should they? They don't make money for being nice; they make money collecting bills. Write a letter and send a copy to each collection company (NOT the individual collector). Explain you have disposable income each month so that you are willing to agree to a payment plan of $X.xx; in exchange for your timely payments of $X.xx, the collection company promises not to call you. That might work, but don't count on it. There is absolutely nothing that requires these guys to stop calling you (unless they are in violation of the law, but you didn't state that)

Re: Collectors off my back

I have a very different legal approach. I would not write them to discuss a settlement, but to advise them to stop contacting your home and work via certified mail return receipt. I fully expect that they will not stop.

I believe that many debt collectors violate the Federal Debt Collection Practices Act and you could potentially be suing them [especially if they keep contacting you]. If this interest you, please visit my web page at www.FloridaCreditLawyer.com and review the articles on what these agencies are NOT allowed to do. Also, feel free to contact my office and I will discuss this situation with you free of charge. Call me at 305.860.1221. You have rights --- so EXERCISE them!
