My company had me travel to work at another state. They paid Per diem but never specified any agreement to return the cash if thery had me return early. I never signed a contract. Am I leagally liable to return the cash?

I can look at this different ways, depending on specific facts. On one hand, if you were paid per diem (per day) for expenses, and you did not actually travel each of the days, it seems the company should only pay you per diem for the days you were traveling. On the other hand, if the company paid per diem in advance and not based on reimbursement for actual expenses, you were not required to spend all the money each day and could keep the excess each day for yourself. But, the second scenario is not what happened from the facts you have given. My thoughts on this would also change if the \"per diem\" was not for daily expenses but constituted part of your pay for the trip and/or if your early return from the trip was at the company\'s request or other reason. Additionally, you have not stated whether the employer asked for return of the money or what portion of the money or what is their justification.\n
