Legal Question in Credit and Debt Law in Florida
credit card debt and summoned
I have 1 county civil summons and 3 small claims I defaulted credit cards in 2004 and 05 when I became hospitalized. Due to my health I have had to file for sos. sec. disablity and have not been granted disability benifits yet. I have no monies, property or assets other than my 12 yr. old vehicle paid for. In Fl. if a jugement rules against me, can they take my car and garnish soc. sec. monthly payment should I be declared disabled.

You are allowed a certain amount of exempt assets. Based on the value of the car, it may be exempt from claims of creditors. Social Security benefits are always exempt.
