Credit co. harassment due to clinic billing incompetency
My four year old daughter has leukemia. We live in Georgia but she is being treated in Florida. We have Georgia medicaid which covers 100% of her bills. The billing dept. at the clinic where she is treated is not filling out the paperwork on all of her claims completely and as a result, medicaid is not paying these claims. I have tried to get this straight with the treatment clinic, but all I get is the run-around. Each person I speak with at the clinic seems to not be the one I need to talk with and passes me on to someone else who isn't the one either. As a result, I am constantly being harassed by credit companies. Can I sue for mental anguish over this situation? If so, in which state? The credit companies call me at my job almost daily as well as at my home. The people calling are verbally abusive to me. I have been told that I am a sorry person for being on medicaid and that I should take responsibility for my bills myself. My daughter has been undergoing treatment for over a year and has another year left to go.

You may have a claim against the treatment clinic as well as a claim againt the debt collectors under the Fair Debt Collection Practices Act. I suggest that you document all of the telephone calls that you are receiving. As for the location of a potential lawsuit against the center, it could likely be brought in either Georgia or Florida if the clinic receives a stream of patients from Georgia. Otherwise, you are better off suing the treatment center in Florida.
