Legal Question in Credit and Debt Law in Florida

Credit Report Defamation of Character

My Bankrtuptcy Chapter 7 was discharged on May 28, 2008. I obtained a copy of my credit report and there are a total of 8 creditors (that were included in the bankruptcy filing) that are still reporting negative status on my credit report. Due to these negative accounts I am not able to rent a home, and have lost some job opportunities. I would like to file law suits against each of these creditors for defamation of character and need to know ''step by step'' how I need to do this on my own. Please advise if I can do this, and if so, ''exactly'' how do I pursue these law suits by myself?

Thank you very much, I appreciate your help very much!

Re: Credit Report Defamation of Character

You can sue each of the creditors (but not the credit reporting agencies) for credit slander, but there may be a simpler and cheaper way. Go to a service like myfico.com and follow the instructions. It may cost you about $35, but you'll be surprised how quickly the erroneous marks will clear up.

If the errors don't clear, credit slander is a complicated lawsuit. You don't want to file without a lawyer, but, if you must, spend a lot of time at the law library learning how to do it. There is no simple, "Credit Slander for Dummies" way to do this. Some lawsuits are just plain hard, either because they have to be or because the people you are suing have expensive lawyers who fight these things all the time. There's a reason we lawyers spend at least four years in college, three years in law school, and many years in practice before we're good at this stuff: it's hard.
