Is my Daughter liable

M daughter lives in Florida and is the main signer of a car loan. Her ex-boyfriend is the co-signer and is on the title and insurance. He took the car out of state, to New York, and is not making any payments on the loan or insurance. the loan company says she is liable to repay te loan. She told them she wants to surrender the car and provided the address of where the car is. She also said that she would report the car stolen because if she is being held responsible, then she wants the car reposessed. She was told that she could not report the car stolen as the co-signer hasthe car and that she could not surrender the car either as his name was on the loan. she also said she would stop paying insurance on the car and that she was supporting herslef and two sons without any help from her ex. Simply put, she can not afford to support herself and sons and his car too. if he will not pay for it then repo it. they told her it was her problem to get the money from him not theirs. any help will be appreciated.

No good answer here for your daughter. She is liable, as is her boyfriend. Best thing to happen is to have car repossessed and seek damages against boyfriend. If she has no money, loan comp will go after boyfriend, if they can find him.
