Debt collection agencies

Dear LawGuru:

Can a collection agency freeze a person's checking account to get money to apply to debts? My balance never reaches $1,000.

Yes, if the debt has been reduced to a judgment. Unless you can prove that the checking account is comprised solely of the earnings of the head of a household, then it can be frozen and eventually garnished to pay towards or satisfy a judgment.

I strongly suggest that you consult a Florida attorney to discuss how you can safeguard your monies. It would be far cheaper to pay for a consultation now, rather than have to hire an attorney after the assests have been garnished to try and undue the actions of a creditor.
