Legal Question in Credit and Debt Law in Florida

debt collection agencies

My wife ran up debt before we met, she was going through a heavy regime of drugs on the doctors orders.

My question is since the debt was discharged by the credit card compnay, what right if any does a debt agency have as I have been getting harrassing calls, and am not sure where I stand

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

Chances are the debt was written off but not discharged. The debtor still owes the money even if a debt is written off. A writeoff of a debt is simply done for accounting purposes but does not relieve the debtor of the obligation to pay.
