Legal Question in Credit and Debt Law in Florida
Is it possible to get someone declared mentally incompetent if they are married and their spouse doesn't want it? My brother was in and out of treatment for years, starting in junior high. He never used to buy anything on credit until he (recently) got married. Now his wife has depleted his savings and has him at least $17000 in debt, could be more. All bills are in his name only. He used to be a model employee before getting invovled with her, but shortly after marriage lost his job due to poor performance. How do we make sure she is held accountable for the debt and not just him?

If the credit cards are only in his name, she is not responsible for the debt. Maybe someone else could speak to you about the incompentency issue.
