Legal Question in Credit and Debt Law in Florida
I'm in some deep trouble and really need some answers. A few years ago, I was naive and trusted my father when he begged and pleaded that I take out an Astrive student loan($30,000.00) so that "I may pay FIU any money owed, I could finally get a little used car and whatever's left over would go towards helping out his business" . He agreed to pay it off or at least make payments before I graduate. Fast forward 4 years later a still car-less me is receiving letters from Wells Fargo (they have taken over Astrive) telling me I have a current balance of $46,779.42. My father took the money, ran off, abandoned the family and is now living with his mistress. I was told that I could be free of this if I get someone to take out a consolidation loan. My father did agree verbally that he would take out this loan. When we went to do this he was told he didn't qualify. Now my father wants me to have my mother take it out if she more qualifies. I would only agree if he signs a promissory note which he agreed to until he saw the numbers on paper.
MY QUESTION:
Since he likes to agree on things verbally, can I record him and have that recording hold up in court. I'm desperate and really need this burden, I never asked for off my back. PLEASE PLEASE HELP!!!!!!!
