Legal Question in Credit and Debt Law in Florida
default judgement I can't pay
Received a copy of judgement and form 7.343 fact info sheet from creditor's attorney. My only income is social security. I have a house and a car that I am financing thru another lender.
I owe $8,300 and the car is valued by NADA at $9600.
My question is: what can the judgement creditor get from me?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.
Probably the creditor can get nothing from you based on the information provided. Social security income is protected under both Federal and Florida law. It cannot be garnished. If the loan amount exceeds the equity in the car, then there is no value there either.
You have an obligation to respond to the information sheet and provide the necessary information. Complete it and file it back with the court. If you don't, you can be held in contempt.
