default judgement

I was served a summons in Aug.2007 and did not respond due to ignorance about my legal rights and financial problems. I did not hear anything about it again until Jan 20th 2009 when I received a motion for final judgment from the lawyer stating that a judgment was entered in this case, I could not find it in my public records so on Jan 27th I went to the court house and the clerks office told me it had just come down from the judge that day and Then I received a final judgment letter from the courts dated Jan. 29th How long can the courts hold this without letting me know what is going on. it was held for over a year. How can I get this judgment vacated? Should I ask for a new trial or motion for an appeal? This is a debt collector ( CAVA ) and it is bogus, they have nothing with my name on it just a standard credit card agreement and the debt is over 4 yrs old from the time of the first summons they admit that the last payment made was in June 2003

Your time to act was when you were served with the suit. You will get no sympathy from the judge. Try to work out a settlement.
