Legal Question in Credit and Debt Law in Florida

delinquent credit card reported to collection agency

I have a credit card that was written off. I was on a payment plan the credit card company would not continue it and I could not meet the amount they wanted after the plan. I told them what i could do and they said they can not work with it. They wrote it off the collection agency called and said they will settle i adviced them i can not come up with a lump some. Tried a loan but was declined. Told them they can come up with a 1/4 or the bal they declined they asked us to take a second mortgage I advised them that my husband said that is not an option. They said then they are going right now to garnish my wages. Its only been with the collection agency about 2 weeks. This card started out as 1,500 and with interest has gone as high as 5,000. I have paid over 3,500 on this card. I would like to know how quickly the go into garnishment and do i have any other options at this point. She says my car will be taken from me also with a garnishment is that true. She said i can not have any outstanding loans with a garnishment.

Re: delinquent credit card reported to collection agency

Before any collection agency can TRY to "garnish", they must first go to court against you and WIN. On my web page, www.FLORIDACREDITLAWYER.com, I wrote a lot of information on what activity debt collectors are prohibited from doing. Look under "articles".

I would like to consult with you on the telephone free of charge so that we can review your legal options. Please call my office at 305.860.1221.
