Disability and Liens

A friend owes court judgements and fines which she cannot pay because she is disabled and on SSI.If she inherits a house can a lein be placed on the house for the judgements and fines.She will be co-owner of the house.

Also does a Lein mean the crediter can sell the house to collect what is owed? Or can they only collect the money if she sales the house?

It appears that the safest way to protect her is for her to file bankruptcy. You will need to discuss this with someone who practices in that area. Also discuss this with a probate attorney.

With respect to the liens, they can potentially create a problem in the future. The fact that she is disabled and on SSI will NOT protect her. I suggest she discuss her case with a Bankruptcy attorney. If they say she can not seek protection from the creditors in Bankruptcy court, then I would contact a Probate attorney so that she can possibly prepare a trust. Hope that helps.
