Legal Question in Credit and Debt Law in Florida

Disputing a written financial contract with an ex.

I engaged in a two and one half year relationship with a woman (ending Apr. 2003). During a break-up I signed a short, handwritten contract agreeing to pay for 1/2 of our accumulated debt (almost all being for furniture, and items she has possession of). We reconciled after this contract was signed and the contract was disregarded and forgotten. We have since broken-up for good, and I have received a letter from her in the mail with a copy of the contract attached. She says if the entire debt is not paid in full, she will take me to court and I'll be responsible for legal fees as well.

It was my impression that the contract had been cancelled when we reconciled. In addition, I no longer have use or possession of any of the property she is charging me for (household furniture, computer, electronic equipment - all property she has).

What can be done? As of right now, it's just a threat that she'll pursue legal avenues. But, I'd like to be prepared should something become of it. It's a total of $7500.00, I don't feel I owe, nor did I gain any benefit from the accumulation of that debt.

Maybe these facts will help:

*All credit accounts were solely in her name.

*Bank account was joint.

Thank-you

If she is willing to give you half the furniture I think a judge will make you pay it. Unless you agreed you are not responsible for attorney fees.

Without knowing more I am reluctant to guess as to the outcome of litigation. Best is for you to attempt a resolution before suit is commenced. Else consult with counsel.
