Divorce and assigned debt

My wife and I were divorced in February in Broward County, Florida. According to our marital separation agreement, she was awarded the house, cars, most of the furniture and, $1000/Month alimony. She was also awarded the mortgages, agreeing to hold me harmless. The second mortgage was in my name alone. She hasn't made a single payment since our divorce and the Banks are calling me and reporting non-payment to credit reporting agencies. Is there anyway to stop all of the credit problems stemming from this and, is she truly legally responsible for the debts to which she was assigned in Circuit Court?

See the atty who represented you in the divorce matter. He should be able to resolve your problems. Until they are, you are responsible for payment to the creditors. Of course you may rights of contibution and or of indemnity but that does not abate the payment obligations.

I assume you had a lawyer representing you at the divorce. Have you called him? I would have to read your agreement and the divorce decree. You may have to bring a legal action to reform the mortgage. Call me at 561 998 9401 to discuss further if you wish.
