Legal Question in Credit and Debt Law in Florida

Domesticating of judgment

I obtained a NY judgment against someone with a bank account opened in Florida at Bank of America. When I spoke with someone in the legal department of Bank of America in NY, they said they cannot freeze the account, even though Bank of America operates in NY, as the account is a Florida account. They claim I have to ''domesticate'' the judgment in Florida and then maybe they can do something. (1) Is this correct? (2) How do I domesticate a NY judgment in Florida?

Re: Domesticating of judgment

This is correct. It would be smart to hire a lawyer because there are certain steps that must be taken. Please feel free to contact my office at [email protected].

Re: Domesticating of judgment

You have to retain someone in FL to do that for you as you are apparently NOT in FL. There are a number of statutes and procedures that you have to follow. First question to ask...HOW MUCH will this cost me (costs and fees) and CAN I RESTRAIN MONEY in the debtor's FL bank account? FL is a debtor state and many laws make collections there difficult. (That's why OJ moved there!). Good luck.
