Legal Question in Credit and Debt Law in Florida

Eviction & Divorce

My husband and I are going through a divorce. I have moved out of the apartment that we were living in. He is the only one on the lease and has not been paying the rent. The apartment complex has issued him a few notices to pay and are threatening a law suit to evict him. My question is... If he gets evicted, even though my name is not on the lease, would this affect my credit in any way because I am married to him?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

It should not as you should not be a party to the litigation if you are not named on the lease. This is not a guarantee, however, that the landlord will not include you in any action. If they do, then you will need to file a motion to dismiss or defend the action.
