Legal Question in Credit and Debt Law in Florida

Ex-husband took responsibility for debt, filed bancruptcy, Now crediter coming a

In a signed letter dated from August 12,2001, Divorcing Husband takes full responsibility for all debt, credit card (joint, otherwise) and mortgage payment, also agrees to pay alimony.

Then in sep/aug 2004 files Bancruptcy, now credit card company coming after ex-wife for $9,000. When seperated and paper signed debt was around $1,100. Is the ex-wife responsible or liable for this being a secondary card holder and, unaware name was not taken off cards immediatly, what grounds does she have to stand on?

Did ex-wife sign the card application or otherwise agree to pay for the charges? If she did, then, she has a liability. Since the creditors were not parties to the divorce agreement, they are not bound by its terms. If you need additional help, call me at 305.940.8080

Note if the obligations was set out as alimony the debts, as owed to you may not be dischargeable. I doubt that is the case.
