Legal Question in Credit and Debt Law in Florida

Failure to Notify of Collections Claim

My husband and i were living in Florida and had many issues with the management, who frequently violated and completely broke the lease agreement. This resulted in us moving from the complex within six months. The lease agreement was for one year, but management broke a number of clauses. They refused our 30 day written notice multiple times and even withdrew twice our rent from our account and refused to refund for nearly a month.

I was checking my credit reports last week and learned that they have put a collections claim (in GA) against my husband and I. There has been no notification of any claim made to myself or my husband, by either the agency or the management group. I have tried contacting them via phone and email multiple times and fail to ever receive a response.

How can I challenge this claim when they refuse to acknowledge me?

Isn't it illegal to file a claim without notifying the party you're placing a claim against?

Don't collections agencies need to notify you if they have a claim against you?

Re: Failure to Notify of Collections Claim

You can challange the claim by disputing it with the credit bureaus. If they verify the claim is true (and you say it isn't), you can sue them for credit slander.
