Legal Question in Credit and Debt Law in Florida

my fiance has recently received a substantial settlement in a law suit. She has been living in a home that is frankly pretty dilapidated. no one has made a mortgage payment(co-signed with previous partner in about six years. a collection agency has recently started to chase her for $40000 in back payments She had planned to purchase another home with her settlement. Can this agency attach or force payment? the home in question is not repairable she has paid the taxes and utilities for the last few years while living with me
