Legal Question in Credit and Debt Law in Florida
Florida debt/Texas Resident
4 Years ago my husband and I lived in Florida, had 2 cars and a large credit card balance. We moved to Great Britain in 2000, my husband's family is there. When we moved, we let the 2 cars get voluntarily repo'ed and left behind the $10,000 credit card debt.(I already have a bankruptcy on my credit so I cant file another one for another year or 2 I think). This year, next month actually, we are coming back over to live in the US, in Texas, and buy a house and live there. We have enough money saved in which to buy an inexpensive home from jobs in England. We know our credit is bad so we dont expect to be able to buy anything on credit here for a long time. Knowing we left behind this debt in Florida, we are scared that when the debt collectors in Florida learn we are back in the US, in Texas, they may try to come and take our house or car.
We are bringing debt with us from England to try and pay off also. We dont want to hide from our Florida debt, we just dont want them to take our house when or if they find out we have one. What can we do?

Re: Florida debt/Texas Resident
It all depends on how old the debts are in Florida and what Statute of Limitations will apply. Credit Card companies sometimes try to avoid the Florida Statutes of Limitations by stating in the contract that the law of "XYZ" State will apply.
I can't give you a firm opinion on what may happen in the future. If I were you, I would pull my free annual credit reports, 1.877.322.8228 and see what the three credit reporting agencies are saying about each of you. Please do not pull them on the internet for various reasons. The reports will arrive around 5-7 business days.
Once you have those reports, you are welcome to contact my office and we can see what they say -- it will be a free of charge telephone consultation. My web page has free literature on how to recover your credit and what your credit rights are. Visit www.FLORIDACREDITLAWYER.com. I know you are in another state now, but much of it are tips which can be used by many. Hope to hear from you.
