Legal Question in Credit and Debt Law in Florida

Florida Legal Debt Collection Methods

A judgement has been entered against me for an unpaid credit card debt. An attorney has written that my wages can be attached and my vehicle, home, posessions and other items sold to satisfy the debt. The attorney also states that I can be forced into court to provide a deposition on my assets that will become public record available for all to see. Is this true in the State of Florida? Also, are tactics of this type legal?

Re: Florida Legal Debt Collection Methods

Your home cannot be forcibly sold if it meets the requirements of the homestead provision of Florida's Constitution. Your wages can be garnished (there will be a hearing), your personal property can be taken, and yes, a deposition is a public record. Your property cannot be taken without a hearing.
