who can garnish your wages?

I purchased a vehicle in mine and my Dads name. I had filed chapter 13 but was unable to finish the payments. I had made arrangements with the finance company to make payments and only pay 1/4 of the total due. The car has no blue book value so they don't want the car. My husband had some heart problems and we missed a couple payments when they turned it over to a Law firm (?). They have called my Dad saying they are going to garnish his wages for the total amount due (Florida). I live in Texas and need to know can they do this and if so what can we do?

Until a judgment is properly obtained no one can garnish.

Until they obtain a judgment in court they cannot garnish anything.
