Legal Question in Credit and Debt Law in Florida

GArnishment of bank account

I am disabled and receiving SS disability. I am in debt with credit cards and am being harassed every day by collections. I make barely enough for necessities with nothing left over for these debts. I own my home and have homestead exemption for my tax purposes. Do I still need to file a declaration of homestead to protect my home or is the exemption enough? Can they garnish my bank account with 2 different names on it and the other person is not on the credit cards? I was under the assumption that they cannot do anything since I am receiving SS but I was also told that once SS money is deposited it becomes just regular money that anyone can attach.

Thanks for your time.

Re: GArnishment of bank account

Until the sue & obtain a judgment they cannot attempt to do anything. Your homestead is exempt whether declared or not. SSI is exempt however, if you are comminglingthem with other funds from someone else you may have a problem. Good luck.
