Re: garnishment law in FL
Wage garnishment is possible under Florida law, but it is complicated and there are exemptions. The Writ of Wage Garnishment is fragile under Florida law, and the debtor must be notified of the availability of exemptions.
Exemptions to wage garnishment are provided under Fla. Statute 222.11, and, in essence, provide that if you are "head of family" then your wages are exempt. To be Head of Family, you must provide 51% or more of the supprt of a minor child or dependant (disabled adult). Children are under age 18 and there is no extension for children in college (it does not work like insurance).
For more information about wage garnishments or if you want to view the statute itself, you can go to our website at www.LaBellaLaw.com and look under Credit (for garnishments) or Tools (to lookup the statute).
