Garnishments Withheld

Can Garnishments be withheld without the garnishee having any prior knowledge.

The garnishee usually has no prior knowledge of the garnishment proceeding. What you may be asking is whether notice of garnishment is required. Again the answer is , in most cases, no.

Garnishment is usually employed as a post-judgment remedy in the manner of an execution, as a means to satisfy the judgment. Of course, notice of the the commencement of suit is necessary. That is accomplished by the filing and service of a summons and complaint.
