Legal Question in Credit and Debt Law in Florida

Possible Harrassment by Collection Agency

I was laid off last year from a high paying job, we've been unable to make our credit card payments. We are considering bankruptcy. Recently a creditor has started calling our neighbors (many whom we don't even know) and asking them to get a message to us. They have also threatened to continue to call them until we resolve the debt. In addition, they told my husband they would call his employer and tell them he is breaking the law by not paying the bill. We have asked them to not call anyone other than ourselves, and they state they will continue to do so. Is this harrassment and what are our rights?

Re: Possible Harrassment by Collection Agency

It appears they are violating Florida Statute 559.

Put every communication in writing. Good luck.
