Howe are you considered '' head of household'', does it do by how you file your tax return, or do they assume that in the case of a married couple, that it would be the husband, or is it based on salary?

Generally, it is assumed that the husband is the head of household. It is supported by the taxpayer's income tax filing with the Internal Revenue Service. Of course, either spouse can claim it and it would be up to the other party to dipute the spouse's claim.
