Legal Question in Credit and Debt Law in Florida
Home Owner Association
Hi Ive lived in my community for six years. Association fees totaling $264.00 are due annually in the month of January. I was late paying my assessment in 2008 due to some financial situations. I paid $150.00 in March and the remaining balance in May of 2008. By this time the Home Association Attorneys have place a lien against my home and sent me certified letters of fees over $500.00. As of today I have submitted letters to the lawyers and board of the home association explaining why I was late; and most importantly letting them know this was the first time I have ever been late. On March 16, 2009 I received a letter from their attorney stating I should pay $1,000.46; over $500 is due now and I was to pay the remaining balance in 3 installments. I do not believe this is fair. What should I do?

Re: Home Owner Association
You may be right. It may not be fair. But that isn't the question. The question is whether it's legal.
Because you were late, the HOA has had to hire lawyers to put a lien on your home and to make collection attempts. If their fees are legitimate--and you haven't listed any reason why they aren't--you should probably pay before the fees get higher.
