Legal Question in Credit and Debt Law in Florida
Hope you can steer me in right direction here goes!! in 2000 we bought a van from ford that year my husband became ill due to injury we had purchased disability ins. from ford thru "bankers life" also they never helped , in dec 23 2000 we made our final & partial payment to them and asked them to pick up the van & they didi in 2001 on our credit report it was reported that hey charged off the balance , then in 2002 they sold the van.
now in 2007 we are served with court papers & a judgement is placed by midland funding .
we didi not go to court because my husband was ill we are both on social security disability & have been , we live in a mobile home which has made me very ill & want desperately to buy a home thru local gov. programs which we qualify for except that we have this "judgement" no one will even help or talk to us to help get financing til this paid up all we have is 2500 to our name. how can we get this resolved or should we just give up i am very sick from my asthma since living here .
sincerely

YOu need to file a motion to vacate the judgement and ask for a hearing. You may get a sympathetic judge and he will issue the Order to Vacate. Be sure to have all your receipts, info as to the Banker's Life etc. to show the court. Bring a copy of your credit report showing the charge off.
