Legal Question in Credit and Debt Law in Florida

Does husband take the fall?

I had a Chapter 11 dismissed and my car was repossessed 4 years ago. Later I married. They now are threatening to put a lein on our house. Can they do that if I was not married at the time I bought the car? The house is in both of our names and was purchased long after the car was taken. What I'm asking is, will my husband be affected by this? I'm pretty sure it won't effect his credit but I'm worried about the lein on the house? Should I have my name removed on the house? Please help fast as you can, we are terrified!!

Re: Does husband take the fall?

Do not be terrified. If the creditor has any valid claim, which i doubt, your husband has no responsibility for it. Again, if it is a valid claim a judgment must first be obtained before anything could be done. Since the house is your homestead, and for other reason, it is beyond the reach of your creditors. Consult with the attorney who represented you in the bankruptcy. You may call me at 305-940-8080.
