Legal Question in Credit and Debt Law in Florida
My husband is retired on social security $1292 a month. He had a judgement for $6500 for a credit card debt - now he received a a copy of a Writ of Garnishment, a copy of the motion for writ of garnishment and the Notice to Defendant and Claim of exemption and request for hearing . Can they garnish his social security? Am I, responsible for this, can they garnish our joint checking/savings account? He does not work and SS is the only source of his income. I work and have social security deposited into our checking/savings account too. We have no personal equity in anything. Even our auto is worth approx what is owed on it, as is our homesteaded house. We are 66 yrs old.

Please fill out and mail back the exemption form as soon as possible and certainily within the time period. Failure to do so will allow the collection company to take money from you when it is not intitled to it.
You seem to be free from collection. But fill out the exemption and appear at all hearings on this matter.
