Legal Question in Credit and Debt Law in Florida

Iam currently in the Florida Dept.of Corrections. I have already served eight years as of today. I would like to know, do I get jail time credit on my second five year term? The supreme court overturned a person's jail time credit, they awarded him credit on his second jail time on the same charges as mines. This person is currently released from prison. Altoghether, I have served 8 years of jail time. I am currently waiting to hear to see if I will get an early release this month from prison. Is there anyway you can tell me who can I cantact, or who can maybe help me attain this matter. The public defender who handle my case, has been transferred out of the county, it would greatly be appreciated, if you can help me, by giving me some answers that I solely need...thank you

If you are currently serving consecutive sentences then you are probably not entitled to credit on the first 5 year sentence. Many people are being given credit for time served on initial sentences on situations where they had consecutive sentences and are re sentenced for a violation of probation (for example a sentence of 5 years doc followed by a consecutive sentence of 5 years probation. If the person violates during the probation period and the sentence on the violation does not also say consecutive then the person is entitled to credit from the first sentence). I am not sure if that was your question. If you are just asking if you receive good and gain time on the sentence that began after the first 5 had run, then the answer is that you should unless your sentence indicated you were not eligible (like a min/man)
