Legal Question in Credit and Debt Law in Florida

Illegal Repossession?

Last night my car was repossessed. I was quite surprised as, I am not behind in any payments.

It turns out that the company that is repossessed the car is a FORMER lien holder. They released the lien about a year ago. I got a clean title with the State of Florida and had no problems.

About 3 months ago, I used the car as collateral for a loan. According to the DMV the only lien on the car is the one that was placed on it 3 months ago when I used it for collateral.

I called the cops immediately and of course they said they could do nothing, including give me the name and number of the company that towed my car. All I was given is the number of the FORMER lienholder.

I have tried to find an attorney in my area and they are all booked up until mid-August.

Any advice would be appreciated.

Thank You

Re: Illegal Repossession?

are you sure the new lien holder is not the same as the old?
