Legal Question in Credit and Debt Law in Florida

need info on credit card debt

we have a comsumer credit company handling our debts. the problem is even that payment is proving to be to high for us. most of the credit i am liable for and my husband is added to the credit cards. my question is this: can i switch all the debts just to my name and then file for bankruptcy. and will my husband be notified in any way if i do. it is the only thing i can think of to get out of debt. i would appreciate your help in this matter. thank you.

To do what you suggest may prove to be a fraud upon your husband's creditors. The downside is that you may never receive a discharge for all the debt. Better, is the both of you seek a discharge in bankruptcy by filing a joint petition. Your question is silent as to why that alternative was not considered or if it was why it was rejected.
