Legal Question in Credit and Debt Law in Florida

Judgement against 2 people?

Is it legal to put judgements on two different people for the same debt? ie. Borrower doesn't pay, loan goes into default, judgement is placed. Company doesn't get and money from judgement so opens new case and files for judgement against co-signer. Is this legal? the co-signer was never made aware of debt for 6 yrs. Now being sued since they can't get anything from ''borrower''

Re: Judgement against 2 people?

It is legal. However, the co-debtor may have a valid statute of limitations defense..which must be alleged as an affirmative defense in the answer. If it isn't it is waived. Consult with an a competent attorney.
