Legal Question in Credit and Debt Law in Florida

Judgement & Sheriff Evaluation (?)

My mother has a judgment against her for $15,000. The opposing attorney has stated that her options are wage garnishment, if the client agrees. If he does not agree, then she was told that they would file a sheriff evaluation (I think that's what she said). The lawyer said that they could sell off the contents of the house, including mine, in order to get the money. He also said that that could include the property/house. Can they legally make her sell her house to repay this money? Is there any recourse we have? My father is disabled and on SSI and my mother only works part-time. If she was to file bankruptcy, would it erase this judgement? She already has two liens against the house. Would they be erased as well? I am considering getting in touch w/ an attorney to figure out what her best options are, but we are concerned w/ how much that would cost.

Re: Judgement & Sheriff Evaluation (?)

The judgment creditor can only reach the NON-EXEMPT assets of THE judgment debtor. I urge you and your mother to consult with competent counsel.
