Legal Question in Credit and Debt Law in Florida

Judgement in another state

My divorce decree states that ex is responsible for credit cards. But the creditor is suing me in court. They called my three year son a bunch of nasty names, refused to let me pay the debt and so on. I told them that I do not live in the state in to which they are trying to serve me. They said it doesn't matter they can sue me anywhere and if I don't show up I have to pay even more. Now I read under the act to where they have to sue the person to where that person resides. Did I read that part right? Because I can't afford to travel over 3 thousand miles to make the hearing.

Not necessarily. The credit card application or agreement may state a place of venue for any litigation. If so, suit can be brought in that state. You may be able to call the court where the suit is being brought and ask to appear by telephone in order to state your case. It is better than ignoring the matter.
