Legal Question in Credit and Debt Law in Florida

Judgment

Several years ago my husband and I willfully turned over our car that we could not make the payments on. Recently, now over 6 years after the fact, we have a judgment placed on us. We are to give deposition in 2 weeks regarding our financial status and must turn over any and all records. That is ok, but my questions are - 1. Is my ''small'' retirement safe - will they seize the little bit I have? 2. We own a deeded timeshare in Vegas - is that safe? 3. What else can they do to us all over a car!? We are good people, just down and out in luck as many are. But, other than those 2 concerns...we have no other assets to our name. My husband is self employed and we have no jobs to speak of between the 2 of us and we are completely broke. Please let me know what to expect as I have never been so down and out in spirit and in mind. We gave up the car owing less than $12,000.00 and to this day, we are told we owe over $35,000.00 in fees and penalties. We have 2 weeks until the deposition and I seem to be crying continuously over the unknown status of our lives over this! My husband and I are 50 years old and basically live day to day...working hard, heads held high and with hope things will improve in our lives...Please help. Thank You.

Your retirement is probably safe, but the timeshare could be seized. You might consider speaking with a bankruptcy lawyer, not just to consider bankruptcy, but becuase a bankruptcy lawyer can tell you whether you have an assets which could be lost in the lawsuit if you don't file bankruptcy.
