Legal Question in Credit and Debt Law in Florida

Judgments and IRA

Hello,

I have a few cc judgments against me in my maiden name which I cannot pay since I don't work because of an illness. The only income in my household is my husbands Soc. Sec. I have a small traditional/SEP IRA in my married name in NY and my mobile home in Volusia county Florida. Can they go after my IRA? How do I protect it. They also just sent me a fact information sheet. Do I have to put my husbands info and my IRA info?

Re: Judgments and IRA

As a general rule, IRAs are protected from being "taken" by creditors. I'm not sure what the "fact information sheet" is, but usually you are not required to list your husband's information, but you are required to list your assets, even if the assets are protected. You should have a lawyer look at the "fact information sheet."
