laws of accepting payment

I had my son almost two years ago and the Dr. that delivered him decided he did not want to wait ten years for the bill to piad in full. He then stopped accepting payments and demanded $150.00 per month payments. My husband and I have sent him $50.00 since Jan and he held onto those payments but within the last two months he has cashed them. Is there any law that states that if he is accepting payment then he cannot sue for the full amount? Also, is there any paperwork that can be written up to dismiss going to a pre-trial conference?
