Legal Question in Credit and Debt Law in Florida
I got a letter in the mail about a bounced check I wrote to publix for $137.00. They want me to pay a total of $389.00. Its from "the broward county states attorney bad check restitution program". Will I be sued if i do not pay this or will it just go on my collections/ credit report? I have a feeling they are just a collection company.

Florida law provides stiff penalties for bounced checks, including three times the value of the check in certain circumstances. However, there are legal requirements the person collecting the check has to comply with before seeking treble or other money damages - namely a written notice is required to be mailed to you. See for example: http://www.checkprogram.com/static_websites/browardcountyfl/notice.htm
The Broward State Attorney does have a program so businesses can send a bounced check report and request action by the state attorney. See the same website above.
If you contact me, I can give you instructions to fax or email a copy of the letter to me; then I will be able to tell you if it is from a bill collector or the State Attorney program.
