Lien on florida home

Can a lien be placed against a home in florida for credit card debt or a motor home repossession. The home is paid for and clear and I have lived there 35 years?

Yes and No. I know you are looking for a simple answer, but there are factors which need to be considered. For example, have the creditors gotten a judgment which is certified and properly recorded? If they have, that is not good, but after 7 years it will expire, so has it been renewed? Another question is if you are the exclusive owner of the home or if it the marital home? If it is the marital home and the judgment came after the marriage and purchase of the home, the lien can be "overcome" by an affidavit of continuous marriage.

As you can see, there are a lot of factors to consider, and sometimes a judgment does become a properly recorded lien against a home. If you have further questions on your case in detail, contact me directly.
