Legal Question in Credit and Debt Law in Florida
Can a lien be placed on a property assessed in a living trust?
I have a judgment order from small claims court and the debtors live in Florida. The debtors have been currently out of USA and they have no record of employment from Jan 2004 to present. There are no wages to garnish. The only property they own is the house (their residence in Fl.) and I recently discovered that they have put their house in a living trust.
Can I still put a lien on the property to make sure that if the house is sold, there still is a chance for me to get the amount of money that they owe me?
Thank you for your response.

Yes, you should be able to lien the property. There are other post judgment actions you can also do given the right circumstances.
